Washington State to Tax All Nicotine-Containing Products Starting January 1, 2026

Washington State

Washington State will include all nicotine-containing products under its “tobacco products tax” starting January 1, 2026, taxing them at 95% of the sales price. The new regulations cover both tobacco-derived and synthetic nicotine products and require businesses to declare their inventory when the new tax system takes effect.

Key Points at a Glance:

  • Effective Date: January 1, 2026.

  • Taxable Products: All products containing nicotine or tobacco.

  • Newly Taxed Products: Synthetic nicotine pouches, disposable vapes, nicotine-containing e-liquids.

  • Tax Base Change: From volume to product sales value.

  • Nicotine-containing vape products will be subject to the tobacco products tax.

Introduction to New Tax Regulations

December 29, 2025 – According to a notice issued by the Washington State Department of Revenue, starting January 1, 2026, any product containing nicotine, whether derived from tobacco or synthetically produced, will be subject to the tobacco products tax. Previously, some nicotine products were subject to the vapor products tax.

Scope of the Tobacco Products Tax

The tobacco products tax applies to all products containing tobacco or nicotine, including cigars, pipe tobacco, chewing tobacco, vapes, synthetic nicotine pouches, nicotine vape products, and any other form of tobacco or nicotine-containing product. Products newly included in the tax scope include synthetic nicotine pouches, disposable vapes, and nicotine-containing e-liquids, which were previously not taxed.

Exemptions and Clarifications

The regulations also clarify that “tobacco products” do not include cigarettes, or drugs, devices, or combination products approved for sale by the U.S. Food and Drug Administration as of December 31, 2024.

Tax Calculation and Declaration Requirements

The tobacco products tax is calculated based on the taxable sales price of the nicotine product. According to NBC Right Now, KOMO NEWS, and other media outlets, the tax rate for all nicotine and tobacco products is 95% of the sales price. Retailers and distributors must declare the value of their existing nicotine product inventory in their first filing after January 1, 2026. A new item will be added to the declaration form: “One-time declaration item: Existing nicotine product inventory as of January 1, 2026.”

Sales Price Determination

If the product is purchased from an unrelated party, the purchase price should be used as the sales price; if the retailer or distributor has an affiliation with the manufacturer or distributor, the actual sales price should be used.

Changes to Vape Product Taxation

Vape product tax is calculated based on the volume of e-liquid and the type of container, while tobacco product tax is calculated based on the value of the product in its original packaging or container. When calculating the tobacco product tax for nicotine-containing vape products, the sales price should be used instead of the volume.

Waste Tax Applied to Nicotine-Containing Vapes

In addition, a waste tax applies to all tobacco products. Previously, vape products were not subject to the waste tax, but since the implementation of the new regulations, nicotine-containing vape products will be included in the waste tax collection. No credit will be provided for vape product taxes previously paid.

Requirements for Businesses

Businesses selling tobacco products must obtain a tobacco sales endorsement for each sales location and can add the relevant license to their business license through their MyDOR account.
