Washington pushes legislation: flavored vapes, menthol cigarettes

A Washington state ban bill targeting flavored tobacco products received a hearing in the House Finance Committee. The bill proposes a ban on the sale of flavored Vapes and menthol cigarettes (Except flavored hookahs) and a tax hike starting in July 2027 to fuel cancer research.

Core points to watch:

  1. The Washington State bill proposes a ban on the sale of flavored tobacco products (e.g., Vapes and menthol cigarettes) and contains additional tax measures.
  2. Revenue from the bill would be used for public health programs such as cancer research and tobacco use prevention.

According to an April 7 report by Fox13seattle, a bill to ban the sale of flavored tobacco products in the U.S. state of Washington regained traction when it received a hearing in the House Finance Committee.

House Bill 2068 proposes to ban the sale of flavored tobacco products, such as Vapes and menthol cigarettes, beginning in July 2027, except flavored hookahs. Rep. Kristine Reeves, a Democrat and the bill’s primary sponsor said at the hearing that

  • “These products do not promote the social well-being of our communities and are especially detrimental to the health of our children, and we want to blaze a new trail for the next generation to avoid tobacco dependence.”

Reeves proposed similar restrictions in another bill this session that failed to gain traction. The new bill further increases taxes and fees on the manufacture, sale and purchase of tobacco products, with the revenue going to cancer research, tobacco use prevention and general operating funds. The bill proposes a $2 per pack tax increase on cigarettes, adjusted for inflation every three years.

The tax increase is intended to compensate for the loss of revenue caused by the downgrade of flavored products and to fund advocacy efforts to boycott tobacco, especially targeting youth smoking.

Opponents argue that flavored Vape products are less harmful than traditional cigarettes and that adults should be free to choose them. They cite federal data pointing to a decline in youth tobacco use in recent years and say it is due to strict enforcement of age limits by store clerks.

  • Yujin Ghim of the Korean Grocery Association of Washington said, “We’re the first line of defense, and the existing system is working well.”

Retail groups are concerned that the ban could decrease business revenue and even force some businesses to close. They believe it could spawn an underground market, causing more harm.

  • Crystal Leatherman of the Washington Retail Association said, “Tax increases are not necessarily effective in limiting access to tobacco or encouraging cessation, but may instead drive purchases from the illicit market.”

Lawmakers have until April 8 to move the bill forward, but a spokesman for the chairman of the House Finance Committee said bills involving taxes are not subject to that deadline.
