US FDA Congress proposes to review vape policy

The recently passed US FDA subsidy bill includes provisions to delay cigarette controls until vape branding changes are completed. The bill has passed the House Agriculture Group Committee and is now at the full stage of consideration by the House Funding Committee.

U.S. Congress is proposing a review of vape policies

As reported on June 17, the recently passed U.S. Food and Drug Administration (FDA) subsidy bill contains a language provision that usually passes. The provision would delay proposed cigarette controls until the FDA achieves regulation and adjustments to vape brands.

Last week, the House Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and related agencies passed the anticipated fiscal year 2025 appropriations bill. The vote was along party lines, with Republicans voting yes and Democrats voting no. The bill now moves to the full House Appropriations Committee. which could make changes before it is sent to the U.S. House of Representatives for a full vote.

In this case, language provisions in the text of the bill often reflect the attitude of some senators toward FDA action. As a government agency, the FDA can essentially set policy without congressional consent. The annual appropriations bill allows elected officials to force the FDA to change course by withholding funds.

FDA funding bill could trigger changes in tobacco regulation

Concerning tobacco and tobacco tar products, the bill strengthens the following provisions that prohibit the FDA from using funds to implement three major regulatory policies:

  • Ban the sale of menthol tobacco in the US
  • Ban the sale of flavored cigars in the United States
  • Limit the nicotine content of the product

When lawmakers introduce these provisions, they usually direct that the FDA cannot do something with funds. In this case. The provision states that the above policy cannot be enforced with funds unless the FDA completes a series of changes related to VAPE brand control. These adjustments include:

  1. Update the Industry Enforcement Priority Guidelines (January 2020) to expand. The scope of priority enforcement for disposable flavored e-cigarette brands (technical terms for VAPE brands). In addition to products based on cigarette bombs;
  2. Issue final rules requiring foreign manufacturers to register.
  3. Cooperate with Customs, Border Protection, and the United States Postal Service to prevent the importation of goods that have received a market denial order (i.e., an FDA denial letter);
  4.  Publish the list of authorized commodities.
  5. Issue “import alarm” to products that may violate regulations;
  6. Submit quarterly reports to Congress on the progress of non-compliant goods.

FDA regulation of tobacco and vape products

In addition. Even if these provisions pass, they may not affect the FDA’s regulation of cigarette and vape brands. In April, the White House announced a delay in a ban on menthol cigarette sales. Most believe the delay will also affect a proposed ban on the sale of flavored cigars, which could be linked to the upcoming election.

However. Although the FDA proposed to establish smoke tar limits in early 2018, there has been no substantial progress in implementing these limits since then.

More likely, these funding restrictions will not end up becoming law. The Group Committee logo is only the first step in the FDA-funded licensing and allocation process. Lately, Congress has generally relied on omnibus appropriations bills. A process by which various appropriations bills are packaged into large funding bills.

Generally, the language passed by the committee is seen as the beginning of an omnibus appropriations bill, but last-minute changes are also common along the way.

Last year, for example, the committee approved a stricter provision that directly prohibits the FDA from enforcing a menthol tobacco ban. A flavored cigar ban and tobacco tar restrictions. At the same time no proposed changes to vape brands.

Previously, Axios reported that Republican lawmakers were nervous about losing a private space to enjoy a cigar inside the Capitol due to a change in House committee chairmanship. Asked House Speaker Mike Johnson to address the issue.
