U.S. Court Takes Action Against Banned Flavored Vape Seller

New York Vape Company Permanently Shut Down Over Alleged Sale of Banned Flavored Vapes

A vape company based on Long Island, New York, has been permanently prohibited from selling flavored vape products after reaching an agreement in a U.S. federal court.

The settlement ends a legal action brought by New York City officials, who accused the company of selling prohibited flavored vapes online and violating federal and local regulations.

The city government said the ruling represents a major step in protecting young people from illegal nicotine products and strengthening enforcement against unauthorized vape sales.

Key Points

  • A Long Island vape company was permanently shut down after allegedly selling banned flavored vape products.
  • The company and its operators face a $1,000 penalty for each future violation of the agreement.
  • New York City officials said the action protects teenagers from illegal flavored vape products.
  • The city continues expanding legal actions against illegal vape distributors and retailers.
  • Authorities are targeting online sales channels that fail to comply with age verification and product restrictions.

Federal Court Agreement Permanently Blocks Flavored Vape Sales

According to a report by AMNY on May 22, a Long Island-based vape company reached an agreement in federal court that permanently prevents it from selling flavored vape products nationwide.

The company, which operated online under the name Price Point (pricepointny.com), agreed to immediately stop selling flavored vapes and cannot distribute these products to New York City in the future.

The settlement resolved a civil enforcement lawsuit filed in November 2024 by New York City Mayor Eric Adams and New York City Corporation Counsel Muriel Goode-Trufant.

The lawsuit alleged that Price Point violated federal requirements, including provisions of the Prevent All Cigarette Trafficking (PACT) Act, as well as public health regulations.

Company Faces Financial Penalties for Future Violations

Under the federal court agreement, the company and its operators, Weis Khwaja and Hamza Jalili, will each face a $1,000 penalty for every violation of the settlement terms.

The agreement prohibits the defendants from engaging in transactions involving flavored vapes or nicotine delivery products intended for sale in New York City.

The restrictions also apply to future companies, affiliates, or related business entities connected to the operators.

New York Investigated Online Sales Without Proper Age Verification

The city’s lawsuit claimed that Price Point continued selling flavored vape products despite previous regulatory warnings.

The U.S. Food and Drug Administration (FDA) issued a warning letter to the company in 2020, stating that its sales practices violated federal requirements.

However, investigators later found that flavored vape products continued to be sold online.

According to the city’s investigation, between May 2023 and July 2024, New York officials completed 20 online purchases from the company without proper age verification or required labeling checks.

The products included candy and fruit flavors that authorities said were particularly attractive to young consumers.

Flavored Vapes Remain a Major Focus of Youth Protection Policies

Flavored vape products have become a central issue in U.S. tobacco control efforts because of concerns about youth access.

According to data from the U.S. Centers for Disease Control and Prevention (CDC), fruit and candy flavors account for a significant share of vape sales nationwide.

Under New York City regulations, only limited flavors are permitted, including:

  • Tobacco;
  • Menthol;
  • Mint;
  • Wintergreen.

Other flavored vape products, particularly those associated with sweet or fruit flavor profiles, are prohibited under city rules.

New York City Expands Legal Crackdown on Illegal Vape Sales

Following the court agreement, Mayor Eric Adams said the action demonstrated the city’s commitment to removing illegal vape products from the market.

Adams stated that New York City has previously shut down more than 1,400 illegal stores and seized more than $96 million worth of unauthorized products.

The city government said enforcement efforts will continue against businesses that sell illegal vapes, especially those targeting young consumers.

City Officials Call Settlement a Public Health Victory

Muriel Goode-Trufant described the agreement as a victory for both public health and law enforcement.

She said the city would continue monitoring compliance with the settlement and take action if future violations occur.

As part of the agreement, New York City waived certain previous claims against the company but retained the right to pursue enforcement actions for any future violations.

New York Continues Legal Actions Against Illegal Vape Distributors

The Price Point case is part of a broader campaign by New York City to combat illegal vape distribution.

In 2023, the city filed a federal lawsuit against four major illegal vape distributors.

In 2024, another lawsuit was filed against 11 New York wholesalers accused of distributing unauthorized vape products.

Those cases remain under review in federal courts as New York continues efforts to strengthen control over illegal vape supply chains.

Online Vape Sales Face Increasing Regulatory Pressure

The shutdown of the Long Island vape company highlights the growing legal pressure on online vape sellers in the United States.

As regulators focus on youth access, age verification, product authorization, and flavor restrictions, online vape businesses are facing increased scrutiny from federal and local authorities.

The case also reflects a broader trend among U.S. jurisdictions seeking stronger enforcement against unauthorized flavored vape products.
