Texas’ new vape law takes effect in September

Texas' new vape law takes effect in September

Effective September 1st, a new Texas law prohibits the sale or marketing of vapes containing tetrahydrocannabinol (THC). Violators face fines of up to $4,000 and up to a year in prison. This change has a significant impact on vendors across the state. Supporters argue that the law will help prevent youth from accessing concealed marijuana vapes, while opponents worry it will drive people to dangerous alternatives. Vendors such as Gruene Botanicals argue that marijuana vapes are crucial for those with chronic pain and post-traumatic stress disorder, and that a complete ban could drive consumers to the black market.

September 2, 2025 – According to a Fox7 report on September 1, Texas will ban the sale or marketing of THC-containing vapes starting September 1.

Senate Bill 2024, which took effect on Monday, September 1, makes the sale or marketing of THC-containing vapes a Class A misdemeanor.

The new law carries fines of up to $4,000 and potential jail time of up to a year.

Saldivar, a cannabis consultant at Gruene Botanicals in Austin, has been forced to make sweeping changes to its operations. THC-containing vapes have been removed from their shelves.

The sale of marijuana vapes is completely banned, and violators may be sentenced to one year in prison

“I’d estimate it’s about 60 to 50 percent of our inventory,” said Sebastian Sandoval, another employee at the dispensary.

Supporters of the new law claim it will help prevent concealed cannabis vapes from getting into the hands of the state’s youth, but opponents worry it will drive people to dangerous alternatives.

  • “When you ban something outright, people are still going to seek out those products. You’re pushing people to the black market instead of allowing them to come into a store like ours where we can educate them about the brand and what’s in the product,” Sandoval said.

Gruene Botanicals believes products like cannabis vapes are important solutions for those struggling with chronic pain, post-traumatic stress disorder, and other conditions.

The future of Gruene Botanicals and other cannabis products is now uncertain.

Senate Bill 6, which seeks to ban all THC-containing vapes in the state, is stalled in the House, but some lawmakers are pushing for its official passage before the end of the second special session.

  • “I think it would be better if we had a regulation instead of a blanket ban. That’s the most effective way we can help this industry right now. Weed out the bad actors and keep people like us who really care about the product we’re providing to consumers,” Sandoval said.

While the new law makes it illegal to sell THC vapes, it does not make possessing one a crime.
