Introduction to the Revised Tobacco Business Act
December 29, 2025 – According to Newsis, the South Korean Ministry of Health and Welfare and the Korea Health Promotion Institute announced that the revised Tobacco Business Act will officially come into effect on April 24, 2026. At that time, vapes using synthetic nicotine will be legally defined as “tobacco.”
First Adjustment in 37 Years
This is the first adjustment to the definition of tobacco since South Korea enacted the Tobacco Business Act in 1988. Previously, the South Korean tobacco regulatory system was centered on the definition of “tobacco leaves,” which resulted in new vape products using synthetic nicotine not being considered legal tobacco for a long time and, therefore, not being subject to many regulatory measures.
Health Warning Requirements
According to the revised law, synthetic nicotine vapes will be subject to the relevant provisions of the National Health Promotion Act, and product packaging must mandatorily display health warning images and text. Health authorities stated they have developed guidelines for health warning labels that conform to the form of vape products and will conduct key inspections of manufacturers and importers to ensure compliance.
Strengthened Advertising Regulations
In addition, tobacco advertising regulations will be strengthened. Tobacco advertisements in retail stores and those published in newspapers and magazines must clearly display health warnings in the lower center of the advertisement.
Restrictions on Use in No-Smoking Areas
With the expansion of the definition of tobacco, using synthetic nicotine vapes in no-smoking areas such as schools, hospitals, and government offices will be subject to penalties. Marketing of flavors and scents targeting teenagers and young consumers will also be restricted, and product packaging and advertising may not highlight flavor elements such as fruit or desserts.
Severe Restrictions on Advertising and Promotion
Advertising and promotional activities will also be significantly restricted. Online advertising, external store displays, and sponsorship of vape exhibitions or promotional events for synthetic nicotine vapes are prohibited, except for designated areas within specific retailers. Sales through online marketplaces or social media are also prohibited.
Strengthened Regulation of Vending Machines
At the same time, the regulation of automated vending machines for vapes will be further strengthened. The locations of synthetic nicotine vape vending machines will be restricted, and they must be equipped with adult identity verification devices. From February 2026, vending machines in educational and environmental protection zones will be gradually prohibited from installation and operation.
