SKE Files UK High Court Appeal “Crystal Bar”

SKE is facing litigation over the “Crystal Bar” trademark issue, and an appeal challenge to the Intellectual Property Office has previously been filed in the UK High Court. The Intellectual Property Office had previously found that SKE had failed to confirm its reputation and support the other party’s trademark registration.

The Grocer reported on December 12 that vape brand SKE was used for its products. Crystal Bar “name faces lawsuits.

Trademark battle escalates again

SKE is appealing to the UK High Court, challenging the previous IP office. This ruling allows UK wholesaler Bargain Busting to continue to register its application in 2022. Crystal Bar “trademark.

In addition, Bargain filed a trademark infringement lawsuit against SKE in Superior Court, Busting.

At the time of the initial application’s release, SKE challenged this, claiming that Bargain Busting knew it had already used the name and had deliberately submitted the application to “disrupt” its business. SKE sued wholesaler Tashmeen Kaur for filing trademark applications used by many other vape brands, calling it “opportunistic behavior.”

In the newly published Intellectual Property Office (IPO) dispute system. SKE argued that it had “soft-launched” the Crystal Bar device to select retailers and evaluators at the e-cigarette Expo in London in December 2021, but failed to convince the official in charge of the objection. They had “by this time accumulated a certain trade and reputation in England”.

A few months after Bargain, Busting registered the trademark in May 2022.

The Intellectual Property Office (IPO), according to the ruling,

  • “The UK trademark system is based on the principle of first to file. If a party wants to confirm that it has external rights, it must show its reputation in the UK on the date of application. SKE failed to confirm that it had a protectable reputation at the time of the application for the relevant date, leading to the failure of the challenge.”

The SKE brand reportedly uses the “Crystal” name across its full line of disposable, smoke-addable, and vaping products.

Stephen Lowry, head of trademark, copyright and design at Bargain Brandsmiths, said the decision by the Intellectual Property Office (IPO) emphasises the importance of a comprehensive, professional re-search prior to application and market use.

  • “These search failures could lead to significant legal and financial consequences, including potential infringement claims and the possibility of re-branding.” Whatever the size of the business, there needs to be due diligence.”
