Russia Considers Tobacco Retail Licensing and Tougher Vape Sales Penalties

Russia tobacco retail licensing

The government of the Russian Federation is considering a bill that would require cigarette retailers to obtain sales licenses and impose heavier penalties on individuals and businesses involved in the illegal sale of tobacco and nicotine-containing products, including vapes.

Key Highlights

  • Russia is considering retail licensing for tobacco sales.
  • The bill covers cigarettes, vapes, e-liquids, and heated tobacco products.
  • Illegal sales could result in significantly higher fines.
  • The proposal aims to reduce the illegal tobacco market.

According to Kommersant on August 14. The Russian government is reviewing a bill that would introduce mandatory retail licenses for tobacco products to strengthen market oversight and combat illegal trade.

Russia Considers Mandatory Tobacco Retail Licensing

The proposed legislation was prepared by Andrey Kutepov, Chairman of the Federation Council Committee on Economic Policy, and Vice-Chairman Alexey Sinytsyn.

Retailers Would Need a License to Sell Tobacco Products

To obtain a retail license, applicants would be required to submit documentation including copies of technical equipment certificates and documents proving ownership or legal control of retail equipment. Retailers would also be required to pay a licensing fee, although the amount has not yet been disclosed.

Bill Targets Illegal Sales of Tobacco and Vape Products

Heavier Penalties Proposed for Unlicensed Sales

The bill would significantly increase penalties for the illegal sale of unmarked cigarettes and tobacco or nicotine-containing products, including e-liquids and heated tobacco products.

Individuals could face fines ranging from 10,000 to 20,000 rubles, public officials from 30,000 to 50,000 rubles, and legal entities from 300,000 to 500,000 rubles.

Lawmakers Say Current Penalties Are Insufficient

According to the bill, existing fines are too low compared with the profits generated by illegal tobacco sales and therefore fail to discourage businesses from participating in the gray market.

Illegal Tobacco Market Continues to Challenge Russia

Finance Ministry Reports Growth in Illegal Cigarette Sales

According to Russia’s Ministry of Finance, the share of illegal cigarette products increased from 11% in 2021 to more than 13% in 2023.

Illegal Trade Has Cost the State Billions of Rubles

The bill states that during the first nine months of 2023, illegal cigarette sales resulted in an estimated 75 billion rubles (approximately US$820 million) in lost government revenue. In the second quarter of 2024, the illegal market share remained at 11.3%.

Russia Strengthens Tobacco Market Oversight

Electronic Licensing System Already in Operation

Tobacco Regulator Expands Enforcement Powers

Since March 1, 2024, the Federal Service for Alcohol and Tobacco Market Regulation (Rosalkogoltabakcontrol) has been authorized to supervise the production and distribution of tobacco products, combat illegal operations, and oversee compliance throughout the supply chain, including manufacturing, purchasing, transportation, and distribution.

Industry Outlook

If approved, the legislation would further strengthen Russia’s regulatory framework for tobacco and nicotine-containing products by extending licensing requirements to the retail sector. Combined with tougher penalties and expanded regulatory oversight. The proposal aims to reduce illegal tobacco trade while increasing compliance across cigarette, vape, e-liquid, and heated tobacco product sales.
