The DTI of the Philippines has issued an amendment law that stipulates that the nicotine content of atomized products cannot exceed 65mg/ml and that all atomized products and new tobacco products must be registered with the DTI or the Securities and Exchange Commission (SEC) online for sale by merchants or distributors through the Internet or e-commerce platforms.

Product standard:
Under Section 18 of RA11900, the Office has a Special mandate (OSMV) for vaping tar and non-nicotine products. The Philippine Food and Drug Administration (FDA) jointly develops and publishes technical standards for commodities to ensure their compliance and safety. Aerosol products containing more than 65mg/ml of nicotine are not allowed to be sold on the market. Compliance with these product standards is mandatory.
Product Registration:
According to Section 19 of RA11900, all vaping products and new tobacco products must be sold in the DTI or the Securities and Exchange Commission (SEC) only by registered online businesses or distributors through the Internet or e-commerce platforms. Goods sold and advertised online must meet IRS Health Warning Requirements and Requirements (BIR) and other conditions, including tax receipts, minimum or floor prices, or other financial marks.
Online Sales:
E-commerce platforms and social media sales facilities can only allow distributors or retailers registered with DTI and BIR to sell atomized tobacco tar and non-nicotine products, equipment, and new tobacco products.
Marketing and promotional restrictions around the school:
It is prohibited to sell, promote, advertise, and display atomized smoke tar and non-nicotine products or new tobacco products within 100 meters of schools.
Designated Smoking Area (DVA) criteria:
Owners or legal persons who set DVA standards and require the installation of an indoor DVA in a building and/or premises must first obtain approval from the OSMV.
Recall, prohibition, or seizure of Illegal products:
The OSMV may direct the recall, prohibition, or collection from the public sale or distribution of non-compliant RA119000, IRR. Vaping tar and non-nicotine products, their devices, and new tobacco products, the Technical Regulations, or amendments thereof.
Opening of special task offices:
DTI has established the “Office of Special Tasks for Vaping Tar and Non-Nicotine Products”. Which is mainly responsible for the administration and tax collection (OSMV) of vaping commodities. The agency will ensure that all atomization products on the market meet technical standards and carry out effective tax collection.
List of online brands:
The OSMV and BIR will maintain a monthly updated online list of DTI and BIR brands of atomized smoke tar or non-nicotine goods, equipment, and new tobacco products eligible for online sale.
