April 8, 2026. According to RTL Nieuws, data from the Netherlands Food and Consumer Product Safety Authority (NVWA) indicates that hundreds of stores across the Netherlands continue to sell illegal vapes despite repeated enforcement actions.

Hundreds of Dutch Retailers Continue Illegal Vape Sales

Based on data obtained through the Government Information (Public Access) Act, NVWA inspections over the past four years resulted in fines in 43.00% of cases and warnings in 5.00% of cases.

The businesses involved include tobacco shops, gas stations, supermarkets, and convenience stores.

244 Companies Reoffend Despite Multiple Fines

The data reveal that 244 companies have continued selling flavored vapes or selling to minors even after being fined at least twice.

Among them, 72 companies have received five fines each, while six companies have accumulated 10 or more fines—highlighting persistent non-compliance.

Merchant Issued 14th Fine During Inspection

During a ride-along with NVWA inspectors, RTL Nieuws observed one merchant receiving their 14th fine.

Inspectors urged the seller to stop illegal sales, but the merchant reportedly responded that compliance was “not financially worthwhile,” suggesting profits outweigh penalties.

Fines and Penalties for Illegal Vape Sales in 2025

In 2025, the NVWA can impose a maximum fine of €1,360.00 for a first offense.

A second violation may result in fines up to €2,060.00, while repeated offenses can accumulate to a maximum total of €22,500.00.

Authorities also have the power to confiscate and destroy illegal products, with disposal costs charged to the seller.

Experts Say Current Enforcement Measures Are Ineffective

Herman Bröring, professor of administrative law at the University of Groningen, stated that the current enforcement system is “not working well enough.”

He argued that repeated violations indicate that existing fines are insufficient deterrents and may be perceived as meaningless by offenders.

Some Retailers Attempt to Evade Inspections

The NVWA reports that some non-compliant merchants are actively attempting to avoid enforcement by hiding or relocating vape products.

Officials describe these as “stubborn merchants” who are familiar with inspection routines.

NVWA Plans Continued Enforcement and Repeat Inspections

Pieter Rijswijk of the NVWA stated that enforcement efforts will continue, with inspectors revisiting businesses multiple times—sometimes up to 10 or 16 inspections per retailer.

He noted that sustained enforcement is expected to gradually increase pressure on violators and encourage compliance over time.
