On July 30, the U.S. International Trade Commission (ITC) issued a Notice of Involvement in Case No. 1392, No. 337-TA-Patent Infringement Investigation.

This case was initially started by the US vape company PAX Labs initiated allegations that several companies were infringing their patents in the US. The case centers on the patenting of several oil vaporization devices containing these devices, as well as their components and products. The companies named in the complaint include STIIZY IP LLC, ALD Group Ltd., ALD (Hong Kong) Holdings Ltd., and STIIIZY Inc.

These patents include Patent Nos. 11, 766, 527 (“the ‘527 patent”). The Notice states that the ITC has finally granted PAX Labs’ request for partial termination of the investigation, and the investigation of claims 4 and 21 of the ‘527 Patent’ has been formally terminated.

ALD, STIIIZY and others are involved

During the investigation. PAX Labs filed a motion to partially terminate the investigation on July 3, requesting that the investigation be partially terminated and, in particular. That the allegations regarding claims 4 and 21 of the ‘527 Patent be withdrawn. PAX Labs subsequently filed a motion for adjustment, stating that the parties did not have any other relevant investigative agreements and that the respondent company did not object to the motion.

On July 11, the ITC Administrative Law Judge issued an Initial Decision granting PAX Labs’ request to terminate the investigation. Which the ITC adopted after reviewing the Initial Decision and deciding not to review it.

The ITC’s decision is based on the legal authority of Section 337 of the Tariff Act of 1930 and Part 210 of the ITC’s Rules and Procedures. The notice, signed by Lisa Decision R. Barton, Secretary of the ITC, signifies the conclusion of the investigative phase relating to these particular patent claims.
