If Trump returns to office: What new changes may vape regulation face?

If Trump continues to hold a slim lead, he could become president again four years after leaving the White House, which would have various implications for the e-cigarette industry. What was Trump’s stance on vapes during his presidency? Based on Trump’s last term as president, Both First (Jan. 20, 2017, to Jan. 20, 2021), a rundown of Trump Nation’s policies and its views on e-cigarette issues is available.

On July 15, U.S. time, former President Donald Trump kicked off the Republican National Convention in Milwaukee, Wisconsin (Donald Trump) He was officially nominated as the Republican Party’s presidential candidate. Earlier, Trump announced on his “Truth Social” platform his decision to choose JD Vance as his vice presidential nominee for the Ohio Senate (JD Vance).

They are fighting incumbent Joe Biden (Joe Biden) Kamala Devi Harris (Kamala Devi Harris), the vice president, in which Americans will vote for a new president of the United States by November 5th. According to an ABC News/Ipsos/Washington Post poll, Biden and Trump have a 46% and 47% turnout among registered voters, respectively.

If Trump continues to hold a slim lead, he could become president again after four years out of the White House, following Stephen Grover Cleveland as president again (Stephen Grover Cleveland) the second president to be elected twice and not serve consecutive terms. Will this have any kind of impact on the e-cigarette industry? What was Trump’s stance on e-cigarettes during his presidency? Based on Trump’s last term as president, Both First (January 20, 2017, to January 20, 2021), a compendium of Trump Nation policies and their views on the e-cigarette issue is presented.

Experiences with the Vape Dilemma

Trump began his term without noticing the e-cigarette issue, but by 2018, vape brands, represented by JUUL, were rapidly growing and capturing the market. The inhalation of vapes by teens has increased significantly, fueled by these companies’ flavoring and aggressive marketing strategies. The Centers for Disease Control and Prevention (CDC) has estimated that more than a quarter of high school students will use e-cigarettes by 2019, and they attribute the surge in data to the appeal of fruits, mint, and menthol.

In mid-2019, the CDC began investigating an outbreak of lung injury associated with vape use, known as EVALI (Lung Injury Associated with the Use of E-Cigarettes or E-Cigarette Brands). The investigation revealed that many cases and uses contained tetrahydrocannabinol (THC) associated with e-cigarette brands, particularly merchandise obtained on informal platforms. Vitamin E acetate (a viscosity enhancer added to some THC products) has been cited as one of the leading causes of lung injury.

The CDC works with the FDA and state public health agencies to issue warnings to avoid the use of illegal vape brands and certain ingredients.

While most of the above cases are related to the vitamin additive in illegal marijuana vapes E Acetate, vapes, and teen addiction have become a health topic that the Trump administration needs to confront, and curbing the proliferation of e-cigarettes among teens has become a top priority.

On September 9, 2019, the FDA first, issued a warning letter to the monopoly-forming vape company JUUL, alleging that the company was selling unauthorized consumer activities (including demonstrations to teens in schools) through labeling, advertising, and/or other unauthorized modifications of risky cigarette products.

FDA Acting Director Ned Sharpless Sharpless-(Ned Sharpless) also warned the industry:

  • “We will take more aggressive action if youth e-cigarette use continues to show a disturbing increase, particularly through the use of vapes to appeal to children’s tastes.”

On September 11, 2019, Trump gave a speech announcing a plan for a total ban on flavored vapes, citing the prevalence of vape smoking among teens. “There is concern that the outbreak of lung disease caused by vaping is continuing.” The New York Times reported 50 deaths from e-cigarettes and more than 2,500 illnesses.

  • “We’re going to have some very strict rules and regulations,” Trump said.

Secretary of Health Alex Michael Azar II, in the Trump administration’s cabinet, has supported a strict ban on flavored e-cigarettes to curb the widespread use of flavored e-cigarettes by teens.

On December 20 of this year, the President signed a bill amending the Federal Food, Drug, and Cosmetic Act to raise the minimum sales age for federal tobacco products from 18 to 21, with the minimum sales age applying to all retail establishments and individuals. The bill goes into effect immediately, and it is illegal for retailers to turn 21 or any person under any age (including tobacco, cigars, and e-cigarettes) to sell any cigarette merchandise.

But should a full-fledged ban on flavored vapes be implemented? The Trump administration is not trying to destroy the entire market.

Brad Parscale Trump campaign chief (Brad Parscale) Trump said after his speech that it (a complete ban on flavored e-cigarettes) would hurt his voter base, leading Trump to repeatedly hesitate to start implementing the ban.

According to the New York Times, groups representing more than 100 e-cigarette stores across the country quickly mobilized. They launched a contest for Mr. Trump on social media platforms “We Vape, We Vote,” The campaign hired an opinion pollster who had worked on the presidential election, and even released video ads in Palm Beach, Florida, the site of Trump’s SeaLake estate.

The Trump administration reduced the proposed ban in the face of strong opposition from industry stakeholders, small business owners, and adult vape users who use e-cigarettes as a cessation tool.

The FDA Final, introduced in January 2020, establishes enforcement policies against unauthorized children’s flavored vapes, including fruit and menthol flavors, and proposes a closed e-cigarette to combat fruit and menthol flavors, but not menthol and cigarette flavors. The FDA states that studies have shown that menthol is far less popular among teens than other flavors and that e-cigarette stores openly Flavored cigarette tar sold in tank systems is also exempt from this ban.

This lays out the basic U.S. policy on flavored e-cigarette brands so far in 2020.

Trump: ‘I should never smoke a vape.”

Although the “free press” like the New York Times usually criticizes Trump, highlighting the controversy between his political tactics, legal issues, and behavior, and questioning his leadership and integrity. But objectively speaking, Trump himself neither drinks nor smokes. According to NBC, Trump claimed before the 2016 election that he was an abstainer from alcohol and that he had never drunk, smoked, or taken drugs.

At a campaign stop in New Hampshire, Mr Trump said he did not smoke, drink or do drugs |

However, when the Trump administration began working on a vaping policy, he not only issued a ban, but also invited several representatives, including medical experts, industry representatives, policymakers, and lawmakers, to attend meetings.

In a speech on youth vaping and the proliferation of e-cigarettes before the policy in 2019 11, he expressed his understanding of the complexity of the e-cigarette problem and his willingness to develop a policy based on thorough discussion and evidence. During the exchange, Trump emphasized the importance of protecting youth several times during the meeting.

  • “While vapes will be an alternative for adult smokers, we can’t let them be the beginning of nicotine addiction and traditional cigarette use among teens …… We should take good care of our kids. We should take good care of our children.”

Meanwhile, mentioning that vapes can be used as an aid to quit smoking for adult smokers.

  • “You know e-cigarettes, you can stop smoking (tobacco), it’s better.”

However, he also inquired about the regulation of the e-cigarette industry, including product standards and safety, as well as his anxiety about a possible illicit market that could emerge after a ban on the use of e-cigarettes.

  • “But if Reynolds Cigarettes or JUUL or you know a legitimate company or a good company doesn’t make safe goods, they’re going to be selling something on the street corner that might not be good.”

Despite discussing various ideas and possible solutions, Trump did not make his final position clear after the exchange, instead stating that he would announce the administration’s decision soon.

On January 17, 2020, after releasing its e-cigarette enforcement policy, The New York Times cited three people with knowledge of the situation, saying Trump harshly criticized Azar II. Trump picked up the phone on his desk and said, “I should never smoke a vape.”, and added a rude remark.

Some media outlets, such as commentators in The New York Times, have argued that Trump’s change in position reflects his broader economic priorities, emphasizing the need for small businesses and jobs to be protected in the vape industry. He advocated for balancing public health and economic impact.

In response, White House spokesman Judd Deere said:

  • “We are committed to implementing the President’s policies to improve America’s healthcare system so that everyone benefits, not just individuals.”

Trump himself said:

  • “We’re going to protect our families, we’re going to protect our children, and we’re going to protect the industry”, noting that some products may soon return to the market.

After this enforcement policy was introduced, associations and organizations that remained concerned about the matter still felt that the policy was “reserved.” For example, other American Medical Association (AMA) organizations have called for stricter laws and regulations, including a complete ban on flavored e-cigarettes as a smoking cessation tool without FDA approval.

Or continued stronger enforcement

If Trump wins this year’s election and successfully returns to the White House next year, his impact on the U.S. e-cigarette industry may continue to take public health and economic interests into account.

Speaking with SKY, a longtime observer of the e-cigarette market in the U.S., SKY argues that the key divergence in the future of e-cigarette regulation will no longer be the FDA’s view on flavors, but rather the issue of enforcement by the U.S. Department of Justice (DOJ), the U.S. Food and Drug Administration (FDA), and U.S. Customs and Border Protection (CBP).

  • “When Trump takes office, DOJ and Customs will be stepping up their enforcement efforts, so he’s going to increase enforcement.

He argued that Trump placed a strong emphasis on the flow of commerce and combating smuggling during his last term in office. At the same time, as a leader who is keen to “exit the group,” the U.S. market may become more closed. Brands and foundries are dispatchable variables, but the demand in the e-cigarette market won’t go away, so the distributor channel will become more important, he noted.

  • “Whoever has the channel will win.”

Trump is also likely to capitalize on the issue of tariffs, much like the trade disputes he initiated last term.

Another variable is his new partner, despite 20222. Trump has announced vice presidential candidate JD Vance, who became Senate Vance has not discussed vapes at length in public, but his stance on the issue of vapes can be extrapolated based on his positions on other public health and policy issues.

Politico, a political media outlet, said Vance has always emphasized the importance of public health. He has criticized the Biden administration’s weaknesses on the drug issue, particularly its heavy-handed investigations of drugs and substances of abuse. He has emphasized the serious impact of the fentanyl dilemma on communities, which is also an important issue of great power cooperation.

Speaking on a blog program, he said:

  • “I don’t care what happens in Ukraine, what I care about is that in my community right now 18-45 the influx of fentanyl from the south is the leading cause of death for seniors.”

As a result, Vance supports increased law enforcement, including illegal drug and narcotics smuggling, to address social issues. He also recommends the construction of a border wall as a key measure to prevent the flow of these substances.30 Trump’s wall was completed for $100 million.

Combined with his overall policy views, SKY believes Vance may support strict oversight and enforcement because he is a politician who is “highly conservative on drugs, marijuana, and other things.” When the issue of e-cigarettes comes to the forefront, Vance may propose similar solutions.

It’s worth noting that even if Trump is eventually able to take office, e-cigarette regulation will be different than it was in 2017, his first term. The entire industry, regulation, and product formats are changing. The most popular type of vape has shifted from a JUUL flex commodity to a disposable one.

During Biden’s tenure, the FDA’s control of e-cigarettes has been criticized from all sides. The FDA’s Center for Cigarettes had to issue a reform plan in response to the investigation, and the original approval period for the PMTA remained slow.

That said, this year, menthol e-cigarettes, which have been rejected multiple times, were also passed with an FDA award for the first time, and the e-cigarette industry generally sees this as a positive sign: the flavor of menthol is officially recognized, which will open up room for growth for compliant companies.

As such, this election is not only a choice between the two candidates but also a major choice for future policy direction. The combination of Trump and Vance, especially on drugs and e-cigarettes, will undoubtedly result in a strong commitment to enforcement and economic protection.

Regardless of the outcome, the U.S. vape market will experience more changes and challenges in the coming years. However, the possibility of a Trump return to the White House makes this election particularly compelling. History may once again witness the return of a former president, and the butterfly’s fluttering wings will at some point set off a hurricane across the ocean in China. Which will have a profound impact on future trends in the industry.
