Hawaii Passes New Vape Laws Requiring FDA Authorization and Banning Disposable Vapes

Hawaii has passed two new laws regulating vapes, significantly restricting the range of products that can be sold in the state. The new regulations require vape and e-liquid products to hold a U.S. FDA Marketing Grant Order (MGO) and ban the sale of disposable vapes starting in 2027.

Key Highlights

  • Hawaii passes two new vape regulations.
  • Products sold must hold FDA MGO authorization.
  • The state government will establish a directory of authorized products.
  • Sales of disposable vapes will be banned starting in 2027.
  • The new rules focus on protecting youth and addressing environmental impacts.

Hawaii Introduces Stricter Vape Regulations

July 8, 2026 – Hawaii has adopted new vape regulations that will further restrict the scope of products available for sale. Governor Josh Green signed two laws requiring vape products to meet stricter FDA authorization standards and banning the sale of disposable vape devices.

FDA Authorization Becomes a Requirement for Vape Sales

Under the newly signed HB1573. Manufacturers of vape devices and e-liquids must submit an annual certification to the Hawaii Attorney General’s Office. This certification must attest that the products comply with state and federal laws and have received an FDA Marketing Grant Order (MGO).

Hawaii plans to create a public directory listing authorized brands, products, and manufacturers. Selling products not included in this directory will result in penalties.

State Representative Scot Matayoshi stated that while the measure will not eliminate vape sales, it will significantly narrow the range of legally sellable products.

Disposable Vape Ban Takes Effect in 2027

A second law, SB2175, mandates a ban on the sale of all disposable vape devices in Hawaii starting January 1, 2027.

Reports indicate that the ban primarily targets disposable vapes containing lithium-ion batteries. The state government views these products as posing risks related to youth usage, waste disposal, and environmental impact.

Sales in violation of the ban may incur fines.

FDA-Authorized Products Receive Limited Exemptions

However, an exemption exists for certain disposable devices that have received an FDA Marketing Grant Order, such as the NJOY DAILY product, which is currently FDA-authorized.

Hawaii’s Regulatory Strategy: Limiting the Number of Vape Products

Hawaii officials have stated that the focus of the new regulations is not to completely ban vapes, but rather to limit the number of products available on the market by leveraging the FDA authorization mechanism.

Currently, the number of vape products authorized for sale by the U.S. FDA is limited; Hawaii anticipates that a large volume of unauthorized fruit- and candy-flavored vape products will be affected by these measures.

The state government believes that reducing the supply of unauthorized products can lower the likelihood of youth exposure to vapes.

Industry Impact on Vape Manufacturers and Retailers

Hawaii’s new regulations mark a shift in U.S. state-level vape oversight from simple sales restrictions to the management of product market access.

Unlike a blanket ban on specific product categories. HB1573 establishes a market screening mechanism based on the FDA’s list of authorized products, making the possession of an FDA Marketing Grant Order (MGO) a key prerequisite for entering the Hawaiian market.

For vape manufacturers, these regulations may increase compliance costs associated with product certification, documentation submission, and ongoing regulatory requirements. Meanwhile, the ban on disposable vapes may prompt companies to adjust their product portfolios, shifting toward regulatory-compliant reusable devices, pod-based systems, or other authorized products.

What Hawaii’s New Vape Laws Mean for the U.S. Market

From an industry perspective, the situation in Hawaii highlights two emerging trends in U.S. Vape regulation: first, curbing the circulation of unauthorized products through the FDA authorization system; and second, addressing policy pressures regarding environmental and public health concerns by restricting disposable devices.

Whether other states adopt a similar model will be a key area to watch in the U.S. Vape market moving forward.
