France Delays Nicotine Pouch Ban Until August 25 Following EU Objections

France has postponed the implementation of its planned nicotine pouch ban until August 25 after several European Union member states raised concerns over the proposed regulation.

The ban was originally scheduled to take effect on May 26 and would prohibit the production, sale, import, export, possession, and use of nicotine pouches across France.

The extension gives French lawmakers additional time to review and respond to objections submitted by other EU countries.

Seven EU Countries Challenge France’s Nicotine Pouch Regulation

The delay follows objections from seven EU member states, including Romania, Greece, Hungary, Slovakia, the Czech Republic, Italy, and Sweden.

These countries submitted “detailed opinions” through the EU Technical Regulations Information System, requesting further clarification and raising concerns about France’s approach to regulating nicotine pouches.

The French government will now have additional time to address these concerns before deciding whether to proceed with the proposed ban.

France Proposes Strict Penalties for Nicotine Pouch Sales and Possession

Under the draft decree, nicotine pouches are classified as “toxic substances” and would be regulated in a similar way to certain dangerous chemicals.

If the ban comes into force as originally proposed, individuals found possessing nicotine pouches could face penalties of up to one year in prison or a fine of €15,000 (approximately US$17,369).

Manufacturers and retailers involved in the production or sale of nicotine pouches could face even stricter penalties, including up to five years in prison and fines of up to €375,000 (approximately US$434,145).

Business Sector Watches the Impact of France’s Nicotine Pouch Ban

The postponement has attracted attention from businesses involved in nicotine pouch manufacturing, distribution, and retail.

While the extension provides more time for regulatory discussions, companies remain uncertain about the future market environment if the ban moves forward.

Industry stakeholders are closely monitoring whether France will maintain its original proposal or make adjustments following discussions with EU member states.

France’s Move Highlights Growing European Debate Over Nicotine Regulation

The controversy surrounding France’s nicotine pouch ban reflects a broader debate across Europe over how alternative nicotine products should be regulated.

As nicotine pouches continue to gain attention in multiple markets, European governments are taking different approaches based on public health concerns, regulatory frameworks, and market conditions.

The outcome of France’s proposal could influence future nicotine pouch policies in other EU countries.
