France Criminalizes Nicotine Pouches: 5-Year Prison Terms for ZYN Possession

France nicotine pouch ban

May 25, 2026. According to a report by the New York Post, the French Ministry of Health has officially banned nicotine pouches, including the brand ZYN, as well as other oral nicotine products. France has become the first European nation to criminalize the “possession and use” of these products, signaling the strictest regulatory stance in the region to date.

Key Highlights

  • France bans the sale of nicotine pouches, including ZYN;
  • Possession and use are now subject to criminal liability.
  • Maximum fines reach $436,600;
  • Sweden criticizes France’s regulatory measures.

French Health Ministry Implements Sweeping Ban on Oral Nicotine

The French Ministry of Health has officially banned the use, possession, purchase, and sale of oral nicotine products. Under the new regulations, the ban applies to a broad range of products, including nicotine pouches, nicotine gum, lozenges, and other similar items. This includes the Swedish brand ZYN, which has seen rapid growth in European and North American markets in recent years.

Criminal Liability: Fines Up to $436,600 and Prison Sentences

Violators of the new regulations face severe legal consequences. The maximum penalties for involvement with banned oral nicotine products include up to five years in prison and a fine of €400,000 (approximately $436,600). While traditional cigarettes and e-cigarettes currently remain exempt, the French government has made it clear that oral nicotine products will be treated with zero tolerance.

Classification as a “Toxic Substance”: Health Risks and Rationale

The French government has officially declared nicotine a “toxic substance” in this context. Health authorities warn that these products pose significant risks, including nicotine addiction, acute nicotinic syndromes, severe vomiting, dehydration, and seizures. A 2023 report by the French Agency for Food, Environmental and Occupational Health & Safety (ANSES) also highlighted that these products are widely promoted on social media, potentially targeting younger consumers.

Strictest in Europe: Moving Beyond Sales Bans to Personal Use

France’s move marks a significant escalation in European tobacco control. While countries such as Austria, Belgium, Germany, Luxembourg, and the Netherlands have already implemented bans or restrictions, those measures primarily focused on the sale of products. France is the first to criminalize personal possession and use, distinguishing its regulatory framework as the most severe on the continent.

“Absurd”: Sweden Condemns the French Regulatory Stance

The ban has sparked a sharp response from Sweden, a major producer of nicotine pouches. Swedish Minister for Trade Benjamin Dousa described the move as “absurd,” likening it to a hypothetical Swedish ban on French wine and baguettes. The Swedish government argues that such restrictive measures undermine the free movement of goods within the EU internal market.

Rising Global Usage and Regulatory Divergence

The market for nicotine pouches continues to grow despite these hurdles. According to the U.S. National Youth Tobacco Survey, nicotine pouches became the second most used tobacco-related product among American minors in 2024. Industry observers suggest that France’s sweeping ban may further deepen the regulatory divide across Europe regarding harm-reduction products.
