Brazilian man sentenced for illegal e-cigarette sales

As reported by Reporterpb on July 21. The Brazilian Federal Prosecutor’s Office (MPF) successfully convicted a man in the case for smuggling and illegal possession of ammunition. The sentence, handed down by the Fourth Federal Court of the State of Paraíba, was four years of imprisonment, one year of detention, and a fine, with the penalty starting with a semi-open prison sentence.

The judgment in the case focused on the defendant’s illegal sale of imported vapes. The Brazilian National Health Surveillance Agency (Anvisa) prohibits the sale, distribution, storage, transportation and advertising of these products due to the lack of scientific verification of their safety. The investigation revealed that the defendants conducted their illegal trade in vapes through two main routes.

Most of the products involved are from China and Paraguay

The first seizure occurred in May 2024. When 52 vapes and accessories were legally seized by the Department of Health (DOH) at the defendant’s father’s bar in Campina Grande. There was a tip that the defendant was promoting and selling these items on Instagram through an and the tip phone number was associated with the defendant. At trial, he admitted to approaching sales through social media and phone calls, but denied dealing directly at the bar.

The second seizure occurred in September 2024. When federal police seized 496 vapes, mostly from China and Paraguay, while executing a search warrant at the defendant’s residence. Additionally, a .22 caliber ammunition was recovered from the defendant’s residence, which was identified as falling into the category of permissible ammunition, and the defendant failed to provide a permit for legal possession.

Based on the background of vape smuggling and the potential harm of the ammunition, the court decided not to apply the principle of misdemeanor. In this regard, the Federal Prosecutor’s Office noted that this decision highlights the commitment of the agency and the federal justice system in the fight against the illicit market of vapes, which is considered a threat to public health and safety. The decision also strengthens the fight against the use of digital platforms for criminal activities.
