Bavaria plans strict regulations on vapes and other products

The Christian Social Union (CSU) in Bavaria, Germany, plans to revise the Health Protection Act to subject vapes, hookahs, and heated tobacco devices to the same strict regulations as traditional cigarettes. These products will be completely banned in restaurants, schools, and other public places. The Green Party welcomes this initiative, emphasizing the importance of protecting children and adolescents from nicotine addiction.

Key Points:

  • Regulatory Upgrade: The Christian Social Union (CSU) in Bavaria, Germany, plans to revise the Health Protection Act to subject vapes, hookahs, and heated tobacco devices to the same strict regulations as traditional cigarettes.
  • Public Place Ban: These products will be prohibited in public places, including restaurants, bars, schools, hospitals, sports venues, and airports.
  • Youth Protection: The Green Party emphasized that vapes and heated tobacco devices could serve as a gateway to nicotine addiction, posing a threat to the health of children and adolescents.
  • Broad Support: The Green Party welcomed the initiative and called for further strengthening of preventive measures to protect children and adolescents from addiction.
  • Implementation Details: The exact effective date of the new regulations is unclear, but Bavaria aims to further solidify its reputation as the strictest federal state in terms of smoking protection.

Bavaria plans to impose the same strict regulations on vapes, heated tobacco products, and hookahs as it does on cigarettes.

According to a report by TZ on August 20, the Christian Social Union (CSU) in Bavaria, Germany, is planning a major initiative to protect non-smokers. Water pipes and vapes will soon be subject to the same strict regulations as traditional cigarettes. This will result in their complete prohibition in restaurants, schools, and other public places.

The Christian Social Union aims to address the issue of vapes seriously. According to the German Press Agency (DPA), Bavaria’s Health Protection Act is slated for corresponding revisions. At that time, vapes, water pipes, and heated tobacco devices will be subject to the same restrictions as regular cigarettes. Specifically, this means that the use of vapes will be prohibited in restaurants, bars, schools, hospitals, sports venues, or airports. Previously, such bans only applied to regular cigarettes—vapes were in a sort of gray area.

Public Place Ban

Klaus Holetschek, chairman of the CSU parliamentary group, made it clear: “Health protection must have no loopholes. Vapes and heated tobacco devices are not harmless lifestyle products; they can lead to nicotine addiction and release harmful substances.” It is worth noting that cannabis vaporizers are already treated the same as tobacco cigarettes. However, vapes are not—but this is about to change.

The CSU is receiving support from the Green Party, which says this initiative should have been introduced long ago. For years, experts have warned: there can be no gray areas when it comes to protecting children and adolescents—even with so-called modern products like vapes,” said Andreas Hanna-Krahl, the Green Party’s health spokesperson. But the Green Party’s demands go further: they argue that we must not only close legal loopholes but also strengthen prevention efforts to protect children and adolescents from addiction.

Outdoor smoking is still generally permitted—unless operators implement stricter regulations. Whether this also applies to vapes remains unclear. The proposed amendments to the law indicate that Bavaria intends to further solidify its reputation as the strictest federal state in terms of smoking protection. However, the exact effective date of the new regulations remains unclear.
