Alabama suspends new CBD and e-cig store licenses

After a six-month moratorium, the Hoover, Alabama, U.S. City Council has suspended the issuance of business licenses for new CBD and e-cigarette stores to mitigate a surge in the number of these stores and violations.

Alabama suspends

According to Hoover As reported by Sun on July 1, the Hoover City Council in Hoover. Alabama passed a moratorium on Monday night (July 1) that lasted six months, suspending. CBD In the meantime. City officials will develop appropriate regulatory provisions for these companies and issue new business licenses to vape stores.

Mac Martin, Hoover City Planner (Mac Martin) The sharp increase in the number of CBD and e-cigarette stores in some business districts has reportedly hurt the business community as a whole.

Martin said the city has also received several complaints about illegal merchandise being sold in some of the stores, as well as some issues with illegal merchandise being sold to minors. In addition, CBD and e-cigarette stores often violate a variety of municipal and state regulations. Including advertising standards and the types of products sold in the stores.

“They will comply for some time and then violate the regulations again…”

In 2019, the City Council adopted specific regulations for vape stores, but there are no similar regulations for CBD stores.

The regulations adopted in 2019 prohibit new vape stores, tobacco stores, and pawn shops. And short-term loan stores within 1,000 inches of a K-12 school, daycare center, church, library, public playground, park, youth center, or other location primarily used for youth activities.

In addition, such stores may only be located in the C-2, C-, or C-4 commercial districts, and must obtain a special permit from the City to operate as a “conditional use” in these districts. In addition, any such store should not be within 1,000 inches of another similar store.

However, these same regulations do not apply to CBD stores. As a result, some stores were licensed as CBD stores, but then they began offering various brands of e-cigarettes. Which put them in violation of municipal regulations. However, this is difficult to detect because of their business classification.

Martin said there are questions about the legality of some products under other premises. Some of the product labels meet state requirements for the amount of THC (tetrahydrocannabinol) in the products. However, the City of Hoover has obtained some of the products and sent them to out-of-state labs for testing. The labeling was found to be inaccurate and the THC content was illegal in Alabama.

The nature of the commodity also makes controls difficult to enforce. As some products make sense on the shelf but become illegal when someone buys them and changes the form of the product (e.g., by adding water or lighting it on fire).

“We are in a period of poor regulation at the state and local level …”

Martin is calling for city officials to have time to study the issue and develop better regulations but in the meantime. They want to avoid any further increase in the number of these stores.

“The moratorium will not affect existing CBD and vape stores just to apply for a new business license or look to replace ownership stores.”

City officials will also be looking at stores that sell CBD or vape brands as side merchandise. Such as general merchandise stores, gas stations, or pharmacies.

John Lyda. Council president (John Lyda) The council believes a moratorium on new licenses is appropriate while city staff evaluates the problem and learns if significant regulatory measures are needed.

Maybe in the end we won’t need to do anything, but in six months we’ll know how to move forward.
