Latvia’s Constitutional Court is due to issue an opinion on legal restrictions banning the sale of flavored vape liquid, which vape maker Pro Vape argues infringes its property rights.
A Latvian vape maker says flavored vaping ban violates property rights
According to TVnet on January 5. Latvia’s Constitutional Court will issue an opinion in the summer of 2025 on the legal restrictions on the sale of vapes containing flavoring ingredients. The restrictions, which have been in effect since the beginning of 2025, were challenged by vape maker Pro Vape.
According to the bill, the sale of vapes and alternative cigarette products containing flavored ingredients will be banned from 2025. The sale of e-liquids and alternatives containing imitation tobacco flavors will still be allowed.
The court will be involved in the review
Pro Vape asked the court to assess whether the amendments complied with the first three provisions of Article 105 of the Constitution. Article 105 of the Constitution of Latvia states that every person in Latvia has property rights and that the use of property can only be restricted by the law, without violating the interests of society and property rights.
Pro Vape claims that these regulations violate its property rights by forcing Pro Vape to make arrangements for its future business decisions within months.
The new laws and regulations also include various restrictions on tobacco alternatives, including a ban on the purchase of such products via remote communications. In addition, the production and marketing of products such as sweets, snacks, and toys are also restricted.
The new law also increases fines for the illegal sale of cigarette goods. It is strictly prohibited to sell related products to persons under the age of 20. Violators will be fined between 280 and 700 euros and legal persons between 700 and 7,100 euros.
Pro Vape criticized the new laws and regulations, arguing that they could facilitate the illicit market, noting that non-tobacco products make up 90 percent of the market. The company said the ban is almost equivalent to a total ban on vape brands.
Pro Vape was founded in 2016 with a registered capital of 2,800 euros and the main shareholder is Martin Yamontz. (Martins Yamonts) is 75 percent owned by Edgar Pitzska (25 percent owned by Edgars Pitzska).
